1. Introduction
Welcome to SereinResourceBay ("we," "us," or "our"). These Terms & Conditions ("Terms") are applicable to your use of our luxury yacht rental services and our website hosted at sereinresourcebay.sbs (the "Service"), which is managed by SereinResourceBay.
In using our Service for arranging a charter or any other ways of accessing it, you consent to adhere to these Terms. Should you not agree with any section of these terms, you are forbidden from using the Service.
2. Service Overview
SereinResourceBay offers a range of top-tier yacht chartering services including, but not limited to:
- Day-long yacht hires
- Evening voyages
- Business retreats
- Private gatherings
- Extended charters
Our services are contingent on the availability of our fleet and prevailing weather conditions. We hold the right to alter or cancel services without prior notice.
3. Booking and Reservations
3.1 Booking Process
When securing a charter, you need to:
- Be at minimum 18 years old
- Submit precise and complete details
- Make a payment for the demanded deposit as indicated in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A booking is only solidified with our receipt of payment and issuing a written confirmation. We retain full authority to decline service to anyone at our discretion.
3.3 Availability
All charters are offered based on the accessibility of vessels and appropriate weather conditions. We will exert reasonable efforts to oblige your requested dates and times.
4. Payment Terms
4.1 Pricing
All of our quoted prices are in € and are inclusive of applicable taxes, unless specified otherwise. These prices are subject to adjustments without prior notification.
4.2 Payment Schedule
- Deposit: A requirement of 50% of the entire cost of the charter, to be paid during booking
- Final payment: To be settled 48 hours before the departure of the charter
- Additional fees (if they arise): To be paid upon the completion of the charter
4.3 Payment Methods
We accept payment via major credit cards, electronic bank transfers, and certified cheques. Payments are processed using secured and encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than 72 hours notice before departure: Complete refund excluding processing fees
- Between 24 and 72 hours prior to departure: Refund of half the amount paid
- Under 24 hours before departure: No refunds will be issued
5.2 Weather Cancellations
In instances where weather conditions are determined unsafe by our captain, we may either:
- Reschedule your booking to the next convenient date at no additional cost
- Issue a full refund if a reschedule is not feasible
5.3 Mechanical Issues
Should there be mechanical faults with the assigned vessel, we will strive to provide an appropriate replacement. If a suitable substitute is unobtainable, a complete refund will be given.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are required to:
- Comply with all orders from the crew
- Use any safety gear provided when necessary
- Declare any medical conditions that might affect their safety
- Stay within designated areas of the boat
6.2 Prohibited Items
Certain items are not allowed on board, including:
- Containers made of glass
- Illegal drugs
- Firearms or other weapons
- Excessive non-alcoholic drinks beyond reasonable personal consumption
- Pets, without prior permission
6.3 Conduct
Passengers should behave in a respectful and orderly manner. We preserve the right to terminate a charter without any refunds if the conduct of any passenger presents a risk to safety or disturbs the enjoyment of other individuals.
7. Liability and Insurance
7.1 Our Liability
We are only financially liable up to the amount paid for the charter. We are not accountable for:
- Injuries that result from passengers' imprudence
- Theft or damage to personal belongings
- Indirect, subsequent, or penal damages
- Delays induced by weather or other unforeseen circumstances beyond our control
7.2 Insurance Coverage
Our operations are backed by comprehensive marine insurance, covering the vessels and services we provide. It is the responsibility of passengers to ensure they have adequate travel and personal insurance.
7.3 Assumption of Risk
By participating in our services, you recognize that activities at sea inherently carry risks, and you agree to take on responsibility for your safety and welfare.
8. Modifications and Itinerary Changes
Itineraries, routes, or schedules may be altered at our discretion due to weather, safety, or operational needs. Effort will be made to offer similar alternative experiences wherever possible.
9. Force Majeure
Delays, cancellations, or changes that arise from events beyond our control, which may include, but are not limited to:
- Extreme weather events
- Natural catastrophes
- Governmental directives
- Termination of port operations
- Vessel mechanical failures
10. Privacy and Data Protection
Your private data will be treated in accordance with our Privacy Policy. By utilizing our services, you approve of the collection and use of your data as described within our Privacy Policy.
11. Intellectual Property
All materials on our website, be it textual, visual or logos, are safeguarded by copyright and trademark legislations. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without our written consent.
12. Governing Law
The governing law for these Terms is the legislation of Spain. Legal proceedings, should they arise, will be conducted within the courts of Barcelona, Spain.
13. Changes to Terms
We hold the right to revise these Terms at any occasion. Amendments will be indicated on our website alongside an updated revision date. Your continued use post any changes implies acceptance of the new terms.
